What is a summary procedure? When is the summary procedure applied?

A summary procedure is defined as procedures applied to the settlement of a civil case that meet all the conditions prescribed by the Code of Civil Procedure in a simpler sequence than the procedure for the settlement of ordinary cases.  The purpose of a summary procedure is to settle the case in an efficient but lawful manner.

The Court shall settle a case under a summary procedure when the following conditions are fully met:

    • The case involves simple details and clear legal relationships; the party has admitted their obligation; documents and evidence are sufficient, ensuring adequate grounds for the settlement of the case and the Court does not need to collect any further documents and evidence.
    • The addresses all parties’ places of residence or head offices are clear.
    • No party resides abroad, and no disputed property is located abroad. An exception is when the party abroad and the party in Vietnam reach an agreement to request the Court to settle the case according to a summary procedure or the parties have produced evidence on lawful ownership of the property and reached agreement on the property’s disposition.
