How are cases settled where the plaintiff or the defendant is absent without plausible reason or leaves the hearings without the Tribunal’s approval?

If a claimant, who has been duly summoned to attend a dispute settlement meeting is absent without a justifiable reason or leaves the meeting without the tribunal’s approval, will be regarded as having withdrawn their petition. In this case, the arbitral tribunal shall continue the dispute settlement only if the defendant requests it to continue or files a counterclaim.

If a defendant, who has been duly summoned to attend a dispute settlement meeting is absent without a justifiable reason or leaves the meeting without the tribunal’s approval, the tribunal shall continue the dispute settlement based on available documents and evidence.
