What are the grounds to set aside an arbitral award?

An arbitral award shall be set aside if:

    • There is no arbitration agreement, or the arbitration agreement is invalid;
    • The composition of the arbitral tribunal or the arbitral proceedings is inconsistent with the parties’ agreement or contrary to the provisions of the 2010 Law on Commercial Arbitration;
    • The arbitral tribunal does not have the jurisdiction over the dispute. Should only a part of the award not fall under the jurisdiction of the Arbitral tribunal, that specific part shall be set aside;
    • The evidence provided by the parties that the arbitral tribunal relied on in issuing the award has been fabricated or forged. In addition, the award will be set aside if the arbitrator receives money, assets, or other material benefits from one disputing party, thus affecting the objectivity and impartiality of the award;
    • The award contravenes the fundamental principles of Vietnamese law.
