What assets cannot be distrained?

The following assets cannot be distrained:

(i) Assets banned under the law; assets used in the service of defense, security and the public interest; assets allocated from the state budget to agencies and organizations.

(ii) The following assets if the judgement debtor is an individual:

    • Quantities of food to meet the essential needs of the judgement debtor and their family during a period of having no new incomes or yields;
    • Quantities of medicines needed for disease prevention and treatment for the judgement debtor and their family;
    • Necessary tools for disabled people and tools used for taking care of sick people;
    • Ordinary objects of worship according to local customs;
    • Essential working tools of small value comprising the major or sole equipment of earning a living for a judgement debtor and their family;
    • Utensils necessary for the daily life of the judgement debtor and their family.

(iii) The following assets of the judgement debtor that is an enterprise, cooperative, producer, business, or service establishment:

    • Quantities of medicines needed for disease prevention and treatment of employees; food, foodstuff, tools and other assets used for serving meals for employees;
    • Kindergartens, schools, medical facilities, vehicles and other assets owned by these establishments and used for non-commercial purposes;
    • Devices, equipment and tools for labor safety protection, fire and explosion prevention, and environmental pollution prevention.
