In which cases are foreign arbitral awards not recognized in Vietnam?

The Court shall not recognize foreign arbitral award if:

    • The parties to the arbitration agreement do not have capacity to conclude such agreement according to the law applicable to each party;
    • The arbitration agreement is not legally valid according to the law of the country that the parties chose to apply; or according to the law of the country in which the award was issued, if the parties did not agree on the applicable law for that agreement;
    • The award debtors (agencies, organizations and individuals) are not promptly and duly notified of the appointment of arbitrators and of the procedures for dispute resolution at a foreign arbitration institution, or due to other justifiable reasons that have resulted in the award debtor’s inability to exercise their procedural rights;
    • The foreign arbitral award includes a dispute not requested to be settled by the parties or exceeds the request of the parties in the arbitration agreement. If the excessive part of the award can be separated from the requested part, the latter may be recognized and enforced in Vietnam;
    • The composition of the foreign arbitration or the procedures for dispute resolution conducted by a foreign arbitrator are not in accordance with the arbitration agreement or with the law of the country where the foreign arbitral award has been issued (if not provided for in the arbitration agreement);
    • The foreign arbitral award has not yet become binding on the parties;
    • The enforcement of the foreign arbitral award has been set aside or terminated by a competent agency of the country where such award was issued or the country of the applicable law;
    • Under Vietnamese law, the dispute cannot be settled by arbitration procedures;
    • The recognition and enforcement of the foreign arbitral award contravenes the fundamental principles of Vietnamese law.
