In which cases shall the Civil Judgement Enforcement Agency be allowed to seize mortgaged assets? How is the right of a mortgagee resolved in this case?

(i) The Civil Judgement Enforcement Agency has the right to distrain the mortgaged asset if the following conditions are fulfilled:

    • The judgement debtor has no assets or has assets but they are insufficient for judgement enforcement; and
    • The value of such assets is higher than the secured obligation and expenses of coercive enforcement.

(ii) In this case, the Civil Judgement Enforcement Agency shall notify the mortgagee and when handling the mortgaged assets, the mortgagee shall have the preemptive right to receive the payment.
