In which cases does a judgement debtor lack conditions for judgement enforcement and what are the legal consequences?

The judgement debtor lacks conditions for judgement enforcement when:

    • The judgement debtor has no income or has a low income which only ensures a minimum living standard for themselves and their dependents. Further, the judgement debtor must have no property for judgement enforcement or has property but the value of such property is sufficient only for paying expenses for the judgement enforcement or such property is not allowed to be distrained or is not subject to judgement enforcement under the law;
    • The judgement debtor is obliged to return specific objects, but these objects no longer exist or are irreparably damaged; or to return papers unable to be recovered or reissued, provided that the involved parties have no other agreements;
    • The address or place of residence of the judgement debtor or the minor consigned to other persons for guardianship cannot be identified.

Should the judgement debtor be unable to carry out judgement:

    • At least once every 6 months, the Civil Judgement Enforcement Agent must verify conditions for judgement enforcement. If the judgement debtor is imprisoned and has time remaining to be served of at least 2 years or a new address or place where the judgement debtor resides cannot be identified, the verification must be conducted at least once a year.
    • After the verification is performed 2 times, and the judgement debtor is still unable to comply with the judgement, the civil judgement enforcement agency shall submit the written verification result to the judgement creditor. Re-verification shall be conducted only if new information is received concerning the judgement debtor’s conditions for judgement enforcement.
