What is the order of priority of payment of money collected from the judgement enforcement procedure?

(i) The order of priority of payment collected from judgement enforcement is as follows:

    1. Expenses of judgement enforcement and an equivalent amount of the local average rental for 1 year if the property subject to enforcement is the sole residence of the judgement debtor and he/she no longer has the money to rent the house or to build a new house;
    2. Alimony; salary, wages, severance allowance, job-loss allowance and working capacity loss allowance; compensation for loss of life, damage to health or mental harm;
    3. Court fees and expenses;
    4. Other debts payable according to the judgement or decisions.

(ii) Regarding the handling of pledged assets or a mortgage whereby the pledgee or a mortgagee is a judgement creditor or in the case of selling the assets that the judgement or decision specified to be distrained to secure the performance of a specific obligation, the sum of money collected from selling the pledged or mortgaged or distrained property shall be paid first of all to pledgee and mortgagee or party with a secured obligation after subtracting all expenses at Item (i).a.

In the case of handling of assets in pledge or mortgage whereby the pledgee and mortgagee are not a judgement creditor, such pledgee or mortgagee shall be paid before other payables.

(iii) The order of payment collected from a bankruptcy judgement or decision is executed pursuant to the law on bankruptcy.
