Who is required to bear the expenses for coercive judgement enforcement?

The expenses for the performance of coercive judgement enforcement are borne by the judgement debtor, unless the law stipulates that these expenses will be borne by the judgement creditor or will be covered by the state’s budget.

(i) The judgement debtor must pay the following expenses for coercive judgement enforcement:

    • Expenses for notification of coercive judgement enforcement;
    • Expenses for purchasing materials and fuel, as well as rental of protective equipment, medical equipment, fire equipment, explosion prevention and other necessary equipment for judgement enforcement;
    • Expenses for asset valuation, assessment, and auction. Expenses for asset reevaluation, except for the expenses for reevaluation upon judgement creditor’s request and for reevaluation due to violations of valuation regulations;
    • Expenses for the rent, safekeeping, and preservation of assets; expenses for loading, unloading and transportation of assets; expenses for the employment of workers and costs of building partitions or dismantlement; expenses for hired measurement and placement of boundary markers for coercive judgement enforcement;
    • Expenses for temporary seizure of assets and papers;
    • Payment for persons directly participating in and protecting coercive judgement enforcement.

(ii) The judgement creditor must pay the following expenses for coercive judgement enforcement:

    • Expenses for reevaluation upon the judgement creditor’s request, except for reevaluation due to violations of valuation regulations;
    • Fully or partially pay the expenses for building partitions or dismantlement should the judgement or decision require the judgement creditor to bear this expense.

(iii) The state budget shall pay the following expenses for coercive judgement enforcement:

    • Expenses for reevaluation of assets due to violations of valuation regulations;
    • Expenses for verification of judgement enforcement conditions;
    • Other necessary expenses pursuant to Governmental regulations;
    • In circumstances, pursuant to the law where the Involved parties are entitled to exemption or reduction of expenses for coercive judgement enforcement.
